My Ordeal in the US - Mufti Abdun Nabi Hamidi

I was invited by the Yuba City Islamic Centre, California to lecture at its annual Meelad-un-Nabi (Commemoration of the Prophets Birth) function planned for 7th April 2007. I left South Africa on the 3rd of April and reached San Francisco airport at 1.00pm on 4th April. As I reached the immigration section, I was singled out and sent to a special counter. An officer at that counter told me to proceed to an office at the back. I was made sit on a chair while an officer brought in my luggage.

I had traveled for 24 hours, and was very tired both mentally and physically. Disregarding my condition I was interrogated. Firstly the interrogating officer thoroughly searched my suitcase, hand luggage, dairies, and wallet. He scrutinized every paper that I have in my possession. Many questions were asked about some of the Islamic papers that I had in my possession. The officer asked me detailed personal questions regarding my birth, where was I born, where did I study, details of all the institutions I attended, my work history, where did I work, names of all the organizations where I worked, their physical addresses, contact person etc. I was interrogated for almost five hours by various officers; each one asking almost similar questions. I found myself repeating my answers many times. I was totally exhausted after my very long trip and now had to undergo this harrowing ordeal for another 5 hours without a moments break. I was totally drained and yet, unsympathetically, they kept asking these questions. I got the impression that they were deliberately trying to trick me into contradicting myself in order to discredit my story so that they could have an excuse to detain me for a longer period. They have been given the right and freedom to detain anyone for up to six months if they so desire. So I had to be careful not to fall for their trap as this could easily happen noting my state of mental and physical exhaustion. I thank Almighty Allah for His Divine Favour in granting me the strength and presence of mind to avoid their trap.

They attempted to link me with some people who are allegedly on the US terrorist list. They questioned me about Khalid Rashid, Ammar and some other name which I never heard of. They persisted with their accusation that I have a link with Khalid Rashid and the other people. I kept on denying their allegation and they refused to believe me.

Finely I was questioned by a female officer. She typed everything and informed upfront that should I be suspected of lying during my questioning and if this was verified I could be sent to jail up to five years. She printed out the questions and answers and made me sign them. She then went back to consult with the other officers and later she informed me that I would not be given an entry visa to the USA. The reason give was that mine was a business visa and that the purpose of my visit was for religious work. I am not aware of these technicalities. However this accusation was false and will be explained later.

At about 12.00am an officer came in and did a thorough body search. Then he hand cuffed me and informed me very aggressively that I was being sent to jail. I had to face the humiliation of being marched handcuffed in front of many passengers at the airport. I could see people looking at me very distastefully thinking that I could be a criminal or a terrorist. I felt very humiliated and embarrassed as I am an upright, respected person and furthermore nothing was proven against me. I was put into the back of a prison van and taken to Santa Clara Jail. My fingerprints and photographs were taken as the normal procedure when locking up criminals. I did not deserve even this humiliation but had to bear it patiently. Any resistance would have made matters worse for me. I was put into a small cell. I was in solitary confinement. It was extremely cold in the cell and to further punish me I was not given blanket or anything else to cover me. It was very cold and I shivered the whole night. After a while they offered me food. I had not eaten all this while and was extremely hungry. They offered me noodles. The ingredient list indicated that it contained pork powder. I did not eat and would not have eaten it anyway as I was not sure of the rest of the ingredients. At 05h00 in the morning I was taken from Santa Clara Jail to another downtown jail in San Francisco. When I was taken out of Santa Clara Jail they searched me once again. This time they removed the string which is used to fasten my Shalwaar (eastern style pant). My one hand was handcuffed to another prisoner I was forced to hold my Shalwaar with the other hand. I spend almost the whole day in this humiliating condition. When I was brought back at the airport I asked for the string because of the discomfort I was experiencing. The female person in charge screamed at me and told me to sit quietly and warned me very coldly that she will not tolerate any further requests. .

My hosts made many efforts to get me out of my predicament. They hired lawyers, made contact with government officials and even the South African embassy. I was not permitted to talk to anyone on the phone, not even my close family. My distraught wife tried many times to talk to me but was refused.

We were later informed that the immigration service in USA falls under Department of Homeland Security. This department takes instruction directly from the president of USA and hey have total disregard for anyone else. They have the authority to put someone behind bars for six months for no solid reason. Thus they could do as they please with total disregard to the civil and constitutional rights of an individual, especially if that person happens to be a Muslim.

I should consider myself fortunate for being detained for only 28 hours. This was obviously due to the untiring effort made by my hosts who engaged lawyers, prominent people and SA Embassy to ensure that I was either give entry or sent back without any further harassment. I saw many other Muslims in the jail in Santa Clara Prison. By their features you could make out that they are Muslims. Some appear to be Pakistanis or Indian, some appear to be from the Arab states and some from Africa. One can assume that these people were not as fortunate as me in having pressure applied from the outside An employee at the airport expressed his sympathy and informed me that this is a daily routine for Muslims entering USA. We are being punished and humiliated just because we are Muslims. This person was almost in tears when he informed me of this.

Finally the episode with regards to my visa… The accusation that mine was a business visa was fabricated. On my return to SA I found out that I was granted B1/B2 visa which is the normal visit visa. I have been to USA five times previously. All the visas granted to me were B1/B2 visas. On some of the visas it was recorded that I am going to USA to deliver lectures at Islamic functions. Even this time when I applied for my current visa, I disclosed in my application that the purpose of my visit was to deliver lectures. Further, the accompanying letter from Yuba City Islamic Centre informed that I was being invited for the purpose of delivering a lecture on Melaad celebration. I have been open and honest and nowhere have I misinformed the US Embassy.

I feel very angry, disgusted and frustrated as my intention was noble. Why should the US embassy issue visas to Muslims if their intention is to discourage Muslims from entering by making the entry painful, fearful and stressful. It is very clear that the USA leadership have a hate for Muslims regardless of whether they are religious leaders or ordinary citizen. We need to make our concerns heard or the matter could become worse for the Muslims in future. The purpose of my informing you of my ordeals is not to get your sympathy but to inform you of the false perception of the Muslims especially in the USA.

Many innocent Muslims throughout the world underwent similar or worse treatment undeservedly in the United States of America. They chose to keep quiet and thus the seriousness of this issue has become muffled. It needs to be highlighted and a stand needs to be taken to ensure that these episodes are not repeated. If we choose to keep quiet, it means that this demeaning humiliating and disgusting actions by the USA are acceptable to the Muslims. This show how weak we have become. Remember that Allah Almighty is behind us, no Power and Might is Greater than Him. Oppression and cruelty is short lived and ultimately the Truth will always prevail.
